Please read these Terms of Use carefully before accessing or using the PhatPharm AI application and related services. By creating an account, downloading the app, or otherwise using our platform, you agree to be bound by these terms. If you do not agree, please do not use PhatPharm AI.

1. About PhatPharm AI

PhatPharm AI is a ketogenic lifestyle application developed and operated by PhatPharm, LLC (“PhatPharm,” “we,” “our,” or “us”). The application provides AI-generated keto recipe suggestions, nutritional guidance, community features, and wellness tools designed to support a low-carbohydrate, ketogenic dietary lifestyle.

PhatPharm AI is affiliated with RejuVe Medical Group and is informed by clinical expertise in therapeutic ketogenic nutrition. However, the application itself is a consumer wellness product, not a licensed medical service.

2. Medical Disclaimer

Nothing in PhatPharm AI constitutes or should be construed as medical advice, and no provider-patient relationship is created through your use of this app. Always consult a licensed physician, registered dietitian, or qualified healthcare professional before making significant changes to your diet, beginning a ketogenic protocol, or discontinuing any prescribed medication or therapy.

Certain populations, including individuals with diabetes, kidney disease, liver conditions, eating disorders, pregnancy, or other medical conditions, must obtain medical supervision before following a ketogenic diet. PhatPharm AI content is not tailored to your individual medical history and should not be used as a substitute for personalized clinical care.

3. Eligibility

You must be at least 18 years of age to create an account and use PhatPharm AI. By agreeing to these terms, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. If you are accessing PhatPharm AI on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.

4. Account Registration

To access full features of PhatPharm AI, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account. We are not liable for any loss arising from unauthorized access that results from your failure to safeguard your credentials.

5. Subscription Plans and Billing

PhatPharm AI offers both a free tier and paid subscription plans. Subscription details, pricing, and features are described within the app and may be updated periodically.

In-App Purchases (iOS / Android): Basic-tier subscriptions purchased through the Apple App Store or Google Play Store are subject to those platforms’ billing terms and are processed by Apple or Google. Please refer to their respective policies for refund requests on in-app purchases.

Direct Subscriptions (Pro, VIP, Platinum): Higher-tier plans purchased directly through the PhatPharm website are processed via our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current rate until your subscription is cancelled.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period; we do not offer prorated refunds for unused portions of a subscription period unless required by applicable law.

We reserve the right to modify pricing with reasonable prior notice. Continued use of the app after a price change constitutes acceptance of the new pricing.

6. AI-Generated Content

PhatPharm AI uses artificial intelligence to generate recipe suggestions, meal plans, and nutritional information. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or omissions.

• Nutritional values are estimates and may not reflect your specific ingredients, brands, or preparation methods.

• Recipes and suggestions are generated based on general ketogenic dietary principles and are not individualized medical or dietary prescriptions.

• You use AI-generated content at your own discretion and risk.

We continually work to improve the quality and accuracy of AI outputs, but we do not warrant that any specific recipe, macronutrient count, or dietary recommendation is complete, accurate, or appropriate for your personal needs.

7. User-Generated Content and Community Features

PhatPharm AI includes social and community features that allow users to share recipes, post content, follow other users, and participate in challenges. By submitting content to the platform (“User Content”), you grant PhatPharm a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content within the app and for promotional purposes related to PhatPharm AI.

You retain ownership of your User Content. You represent that you have all rights necessary to grant the above license and that your content does not violate any third-party rights or applicable law.

You agree NOT to post content that:

• Is false, misleading, or constitutes medical misinformation

• Is abusive, harassing, defamatory, or discriminatory

• Infringes any intellectual property right

• Contains spam, advertising, or unauthorized commercial solicitations

• Promotes disordered eating, dangerous dietary practices, or self-harm

• Violates any applicable local, state, federal, or international law

We reserve the right to remove any User Content at our sole discretion and to suspend or terminate accounts that violate these guidelines.

8. Prohibited Uses

You agree not to use PhatPharm AI to:

• Circumvent, disable, or interfere with any security or access control features

• Reverse engineer, decompile, or attempt to extract the source code of the application

• Scrape, harvest, or collect user data without authorization

• Use the app for any unlawful purpose or in violation of these terms

• Impersonate any person, entity, or affiliation

• Transmit viruses, malware, or any other harmful code

• Use automated bots or scripts to interact with the platform

9. Intellectual Property

All content, design, code, trademarks, graphics, and materials within PhatPharm AI, excluding User Content, are the exclusive property of PhatPharm, LLC or its licensors. The PhatPharm name, logo, and brand elements are protected trademarks and may not be used without prior written permission.

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use PhatPharm AI for your personal, non-commercial purposes.

10. Privacy

Your use of PhatPharm AI is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. We encourage you to review our Privacy Policy to understand how we collect, use, and protect your personal information. By using PhatPharm AI, you acknowledge and consent to our privacy practices as described therein.

11. Third-Party Services

PhatPharm AI may integrate with or link to third-party services, platforms, or content. We do not control and are not responsible for the practices or content of any third party. Links to external sites are provided as a convenience only and do not constitute our endorsement of those sites or services. Your interactions with third-party services are governed by their respective terms and privacy policies.

12. Disclaimers and Limitation of Liability

PhatPharm AI is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content generated by or displayed within the application.

To the fullest extent permitted by applicable law, PhatPharm, LLC, its officers, directors, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use PhatPharm AI, including without limitation damages for personal injury, loss of data, loss of revenue, or any other intangible losses, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these terms shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or fifty U.S. dollars ($50.00).

13. Indemnification

You agree to defend, indemnify, and hold harmless PhatPharm, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of PhatPharm AI, your User Content, your violation of these terms, or your violation of any third-party rights.

14. Termination

We reserve the right to suspend or terminate your access to PhatPharm AI at any time, with or without notice, for any violation of these terms or for any other reason in our sole discretion. Upon termination, your right to use the app ceases immediately. Provisions of these terms that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, indemnification, and limitations of liability.

15. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws provisions. Any dispute arising from or relating to these terms or your use of PhatPharm AI shall be resolved through binding arbitration conducted in Prince George’s County, Maryland, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized access.

You and PhatPharm agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the “Last Updated” date above and, for material changes, provide notice through the app or via email. Your continued use of PhatPharm AI after any changes constitutes your acceptance of the revised terms. If you do not agree to the updated terms, please discontinue use of the application.
